1. Introduction
Welcome to NOD: Smart Capsule Machine app. Please read the following Terms of Service carefully before using this app / website or opening a NOD account (“Account”) so that you are aware of your legal rights and obligations with respect to PT. Muara Juara Kreasi Indonesia and its affiliates and subsidiaries (individually and collectively, “NOD”, “we”, “us” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our app and services (collectively, the “Service”).
The Services provided through this app include bluetooth connectivity to our products and remote control ability which allow you to operate, control, and monitor our designated machines from a centralized server. This app also provides a purchasing platform enabling the purchase of products between you (“buyer”, “user” or “users”) and the seller (“seller”, “us”) directly through the app. Including and not limited to the purchase of monthly subscription options that grant access to additional features and services.
Before becoming a user of the app, you must read and accept all of the terms and conditions in, and linked to, these Terms of Service and you must consent to the processing of your personal data as described in the Privacy Policy linked hereto. By downloading or using our app, you agree to these Terms. If you do not agree to these Terms, please do not use our app.
2. Acceptance of Terms
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the Service, including visitors, registered users, and others.
3. Eligibility
You must be at least 17 years of age to use our Service. Our services are available for use in Indonesia. Accessing or using the services outside these regions may not be available. It is your responsibility to ensure that your use of the app complies with all applicable local laws and regulations. By using the Service, you represent and warrant that you meet these requirements.
4. Account Registration and Responsibilities
To use certain features of the Service, you may be required to create an account. When creating an account, you agree to:
- Declare that you are a competent person and are able to bind himself/herself in a legal agreement according to law.
- Be responsible for maintaining the confidentiality of the account for all activities that occur in the user’s account.
- Notify us immediately if there is any unauthorized use of the user’s password or account.
- Provide accurate, current, and complete information.
- Maintain the security of your account by safeguarding your password.
- Be responsible for all activity on your account.
Upon registering an account;
- Users who have registered have the right to act as Buyers.
- Registered accounts cannot be deleted, except by special request
- Registration uses a Mobile Phone Number and Email along with an OTP that will be sent to the registered mobile phone number.
- Data in the form of Birthday is required and will only be used for internal promotional activities.
You hereby agree that we are not responsible for any losses or obstacles arising from misuse of the user’s account caused by the user’s negligence, including but not limited to lending or providing account access to other parties, accessing links or links provided by other parties, providing or showing verification codes (OTP), passwords or emails to other parties, or other user negligence that results in losses or obstacles to the user’s account.
If any alleged violation or violation of the Terms & Conditions and/or applicable laws is found, we have the authority to take necessary actions, not limited to immediate account suspension, permanent account termination, forfeiture of earnings or rewards, financial restitution, and legal action, without prior notification to the user.
5. License and Access
We grant you a limited, non-exclusive, non-transferable, revocable license to use our app for personal, non-commercial purposes. You agree not to:
- Create and/or use devices, software, features and/or other tools that aim to manipulate our Service, including but not limited to: (i) manipulation of Store data; (ii) crawling/scraping activities; (iii) automation activities in transactions; (iv) other activities that can be reasonably assessed as acts of system manipulation.
- Modify, distribute, or sublicense any part of the Service.
- Access the Service using automated methods.
- Interfere with or disrupt the operation of the Service.
6. Purchases and Payments
Our app offers products, services, or subscriptions for purchase:
- All prices are displayed in Indonesian Rupiah and are subject to change.
- By placing an order, you agree to pay the listed price and (if any) applicable taxes or fees.
- You may only change their preferred mode of payment for their purchase prior to making payment.
- All Orders cannot be canceled if they have been paid.
- We may use third-party services for processing payments. Please review their policies, as we are not responsible for any actions taken by these third-party providers.
Purchasing process, include:
- Product Delivery
- The user can use product delivery and is deemed to agree to the terms and conditions set by the relevant Third Party. We are not responsible for any losses experienced by the user caused by negligence or any form of error made by the relevant Third Party.
- Complaints about the product delivery service experienced can be reported to our Resolution Center.
- Shipping Rates
- The basic rate for shipping the products ordered by users will follow the price according to the Third Party’s policy. We are not responsible for determining the basic shipping price set by the Third Party.
- Promo
- Changes in Product Prices or Shipping Rates related to Promos held by NOD will follow the terms and conditions of the current Promo.
This service supports one or more of the following payment methods:
- Credit Card
Card payments are processed through Third Party payment channels and the type of credit cards accepted by these payment channels may vary depending on the jurisdiction you are in.
- QRIS Payment
QRIS Payment is standardized and can be paid using various payment platforms which support such functions. You can scan or upload the QR code with your mobile payment app and confirm the transaction.
- Other online payment channels
Buyers may pay through the various online payment channels available on the app.
We take no responsibility and assume no liability for any loss or damages to Buyer arising from shipping information and/or payment information entered by Buyer or a wrong remittance by Buyer in connection with the payment for the items purchased. We reserve the right to check whether Buyer is duly authorized to use a certain payment method, and may suspend the transaction until such authorisation is confirmed or cancel the relevant transaction where such confirmation is not available.
All compensation for errors by Third Parties or NOD will be replaced in the form of NOD Coins in accordance with NOD policies within a maximum period of 3 x 24 hours.
7. Subscriptions and Cancellations
Our app offers subscription plans with distinct features, durations, and pricing. Users must carefully review and select the plan that best suits their needs. Plan details are available on the subscription page of the app.
- Billing Cycle: By subscribing, users agree to pay the applicable fees for their chosen subscription plan, which is billed on a monthly basis. Payments will be charged to the user’s designated payment method at the start of each billing cycle.
- Renewal: Unless canceled before the end of the current billing cycle, subscriptions will automatically renew for the same period and at the same rate as the original plan. Users are responsible for managing their subscription settings to avoid unwanted renewals.
- Cancelation: Users may cancel their subscriptions at any time through the app’s account settings. Cancellation will prevent future charges, but users will retain access to subscription features until the end of the current billing cycle. Refunds for unused portions of a subscription are not provided unless required by law.
- Price Changes: The platform reserves the right to adjust subscription prices. Users will be notified of any price changes at least 30 days in advance, and changes will take effect at the start of the next billing cycle. Continued use of the subscription after the price adjustment constitutes acceptance of the new rate.
- Account Responsibility: Users are responsible for ensuring that their payment information is accurate and up-to-date. Failed payments may result in suspension or termination of the subscription and access to associated features.
- Non-Transferability: Subscriptions are non-transferable and may only be used by the registered account holder.
- Changes to Subscription Features: The platform may update or modify the features of any subscription plan to enhance user experience. Significant changes will be communicated to users in advance.
- Termination by the Platform: The platform reserves the right to terminate or suspend a subscription for any user who violates the terms and conditions, engages in fraudulent activity, or misuses the subscription features. In such cases, no refund will be provided.
- Refunds: Refunds for subscription fees are only provided under specific circumstances as outlined in the app’s refund policy or as required by applicable law. Users may request a refund through customer support.
8. Intellectual Property
All content and materials in our Service, including text, graphics, logos, and software, are owned by NOD or our licensors and are protected by intellectual property laws. Unauthorized use of any materials may violate copyright, trademark, and other laws.
9. Termination
We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, for any conduct that violates these Terms or is otherwise harmful to our interests.
10. Disclaimers and Limitations of Liability
Our Service is provided “as is” without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
To the fullest extent permitted by law, NOD and its affiliates will not be liable for any damages arising from your use of the Service, including but not limited to direct, indirect, incidental, punitive, or consequential damages.
11. Changes to the Terms
We may update these Terms from time to time. Any changes will be effective immediately upon posting on the app. Your continued use of the Service signifies your acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of laws rules. You agree that any legal action or dispute that may arise out of, relate to, or be in any way connected with the service and/or this Agreement shall be resolved exclusively within the jurisdiction of the courts of the Republic of Indonesia.
